MacElree Harvey’s Municipal Distress and Recovery team is comprised of lawyers and other professionals that work collectively to take a holistic approach to solving the problems that plague local governments across the Commonwealth. Often, addressing these problems “piece-meal” will only address the symptoms-not the causes-of municipal distress. Our team has experience working closely with the Pennsylvania Department of Community and Economic Development (“DCED”), the state agency charged with administering the Municipalities Financial Recovery Act (“Act 47”). Act 47 outlines the ways in which DCED may assist Pennsylvania municipalities that are experiencing financial difficulties in order to ensure the health, safety and welfare of the citizenry.
We have experience advising clients on developing innovative ways to identify potential revenue streams and can help local governments evaluate public private partnership (P3) opportunities to monetize public assets. Often, these transactions can be structured in a way that allows the municipality to maintain control of the asset. Our Litigation and Bankruptcy attorneys have broad experience in the areas of restructuring, bankruptcy, and complex commercial litigation. We have experience representing debtors, creditors’ committees, and other parties-in-interest in complex bankruptcy cases, and are familiar with the issues surrounding municipal defaults, remedies and work-outs.
