Collecting debts. When you are owed money and want to collect what you are owed, we have attorneys who are very skilled in helping you do so.

Our attorneys understand the importance of suing the right entity in order to obtain a judgment against which you may collect. They understand the differences between secured and unsecured creditors and the ins and outs of mortgage foreclosures and sheriff's sales of personal property and real estate. Further, MacElree Harvey attorneys know how to levy on bank accounts as well as liquor licenses.

In cases that require it, our attorneys know the intricacies of bankruptcy and whether the threat by a debtor to file bankruptcy is one which should concern you or not. We know when a mechanic's lien can be filed, how to do it, and its relationship to the bankruptcy laws.

Protecting you from bankruptcy by others. The members of MacElree Harvey's bankruptcy practice represent creditors in Chapters 7, 11 and 13 cases and are skilled in obtaining relief from the automatic stay to foreclose on your mortgage. They know that you may file a mechanic's lien even after the debtor has filed for bankruptcy because it relates to the earlier time the work began. They know how to keep a debtor from being able to discharge your debt in bankruptcy because of fraud or misrepresentations made by the debtor and have been successful in doing so in many significant bankruptcy cases.

Representing Debtors. We will make sure your rights are protected and that creditors comply with the Fair Debt Collection Practices Act, the rules and regulations of the Pennsylvania Housing Finance Agency, the Equal Credit Opportunity Act, the Plain Language Consumer Contract Act, the Fair Credit Reporting Act, the Truth in Lending Act and the Uniform Commercial Code and its applicability to different transactions.
